What Is This Lawsuit About?

This settlement involves GM vehicles that were factory-equipped with Dex-Cool. Dex-Cool is an engine coolant designed to protect vehicles' engine and cooling systems. A number of lawsuits were filed as class actions against GM in state and federal courts across the United States involving "Dex Cool." Among other things, the lawsuits allege that (i) Dex-Cool in the vehicles caused problems with the vehicles' engines or cooling systems, and (ii) that certain engine components, such as the nylon/silicone lower intake manifold gaskets equipped in certain vehicles, were defective.

What Are The Symptoms?

In a typical scenario, the area known as the "Lower Intake Manifold Gasket" begins to leak at certain areas both externally and internally. These leaks, if left un-repaired, will lead to loss of engine coolant, and in some cases lead to internal engine damage and possible failure. During the course of Dex-Cool degradation, a "sludge-like" condition may occur which can possibly lead to the clogging of the cooling system and heater core. The most common and visible signs are spots of fluid that fall onto your driveway or parking area.

Additionally, engine oil may begin to leak within the same areas, leaving the possibility of fluid buildup and puddles occurring at both sides of the engine. This may cause premature serpentine belt and tensioner failure.

How Do I Know If I Am Affected?

First and foremost, please read below the groups of vehicles that the class action references. In our opinion, we recommend recording your Vehicle Identification Number (VIN) then call or email Buckley's Auto Care to allow us to reference the actual date of manufacture, along with the location of where the vehicle was made and what engine codes pertain to your vehicle. This is vital information that will be necessary and through our proprietary management system, it is at our disposal whether you are a first or second owner. SINCE MOST OF OUR READERS ARE CLIENTS, WE RETAIN YOUR VIN. If you are not a current client, we can obtain your information during our NO OBLIGATION INSPECTION. (see details below)

What Is The Amount Of The Proposed Settlement?

According to the most recent documents, the amount of the proposed settlement can range between $50.00 (for high mileage, 7th year models) to $800.00 for years 1 thru 5. All vehicles must have mileage less than 150,000 miles.

What Can I Do To Verify And Prepare For The Settlement?

As a courtesy for all of our clients and their referrals that may be affected, Buckley's Auto Care will conduct a FREE COOLING SYSTEM INSPECTION to verify the vehicles overall condition. NOTICE: If you have already have had the lower intake manifold gaskets replaced, we will supply a copy of your receipts for processing. A formal letter that addresses this concern is being sent via postal mail to our GM Client base.

DUE TO THE NATURE AND SEVERITY OF THIS SITUATION, WE WILL EXTEND THIS FREE COOLING SYSTEM INSPECTION FOR EVERYONE THAT MEETS THE MAKE/MODEL CRITERIA OF THE CLASS ACTION SETTLEMENT. By offering this we encourage you to inform and invite your friends, relatives, and colleagues to participate in this NO OBLIGATION inspection.

In addition to our FREE COOLING SYSTEM INSPECTION, Buckley's Auto Care will provide the necessary documents that will be needed for your inclusion in the settlement. All paperwork can be filled out at the time of the inspection and your signature will be required. For your convenience, Buckley's Auto Care will PAY FOR THE POSTAGE so that the documents are mailed in a timely manner.

PLEASE, this particular condition is of a severe nature with internal engine failure a possibility if it is to go un-checked. We have performed a countless number of these repairs on all of the stated models and the opportunity for reimbursement appears to be present. THE DEADLINE FOR FILING A CLAIM IS AUGUST 13th, 2008. We encourage all of our clients and prospective clients to ACT EARLY and FILE IMMEDIATELY to minimize delays.

WHAT SHOULD I DO NOW?
